THE Constitutional Court has upheld five election petition appeals among them Kasama Central and Nalikwanda constituencies after finding that the petitioners failed to prove allegations of electoral malpractices. According to five judgements delivered today, the court upheld the decisions of High Court judges who found that Kasama Central PF member of parliament Kelvin Sampa, Nalikwanda UPND’s Professor Geoffrey Lungwangwa, UPND’s Gift Sialubalu of Sinazongwe, Elliot Kamondo of Mufumbwe and Rogers Mwewa who is PF Mwasabombwe member of parliament were validly elected. In the Kasama Central parliamentary seat that was petitioned by UPND’s Sibongile Mwamba, Constitutional Court judge Mungeni Mulenga said the court did not fault the findings of the lower court which dismissed all the grounds, stating that Mwamba failed to prove that Sampa engaged in electoral practices during the August 2016 elections. The court dismissed all the grounds advanced by Mwamba among them that the raid at her house was sanctioned by Sampa and also that he donated shoes in order to influence voters. She said there was no evidence to show that the shoes were donated during the campaign period. Judge Mulenga said there was no evidence to prove that the unfair and hate speech messages that were put on banners and flyers alleging that UPND president Hakainde Hichilema was a Satanist were orchestrated by Sampa or his agents to prevent the electorate to vote for Mwamba. She said the allegation that Sampa distributed alcoholic beverages also failed because the evidence on the same was not corroborated. “The appellant did little to establish that the first respondent distributed alcohol and therefore, we will not fault the findings of the trial judge,†judge Mulenga said. She also dismissed all the grounds of appeal in the Nalikwanda petition appeal, saying they lacked merit. Judge Mulenga said the Constitutional Court would not doubt the findings of the lower court as it had an opportunity to observe the demeanour of the witnesses and also the benefit of seeing the witnesses. She said the court would not reverse the findings of facts based on the credibility of witnesses. Judge Mulenga added that the ground that Prof Lungwangwa distributed K100s was not proved because there was no evidence to show that the member of parliament distributed the monies and they cannot fault the lower court’s finding. And judge Margaret Munalula upheld the election of Mwewa after dismissing the grounds of appeal filed by Sunday Chitundu Maluba of the MMD for lack of merit. Judge Munalula also dismissed the Sinazongwe appeal lodged by PF losing candidate Richwell Siamunene against Gift Sialubalu. Meanwhile, judge Palan Mulonda threw out PF’s Steven Masumba’s appeal against Kamondo of the UPND for failure to prove the allegations of electoral malpractices. Mugabe has been under house arrest from Tuesday when army generals took over power claiming to act in public interest. The 93-year old has reigned over Zimbabwe over 36 years and has been lining up his wife Grace to take over from him. Things fell apart when he sacked his Vice President Emerson Mmnanagwa in what was seen as a move to pave way for his wife, Grace to take over. Following a meeting by beleaguered Zimbabwe President Robert Mugabe, Zimbabwe Defence Forces (ZDF) Commander General Constantino Guveya Chiwenga and others at State House in Harare yesterday, uncertainty continue to cloud the political climate in the southern African nation. There is no official statement to outcome of the meeting, but speculation is rife a deal was reached for President Mugabe to officially leave office. The scanty information available from the meeting suggest the parties have not agreed about when President Mugabe should leave. The meeting was attended by South African envoys comprising Defence Minister Nosiviwe Mapisa-Nqakula and State Security Minister Bongani Bongo. Others that were part of the meeting are Roman Catholic cleric Father Fidelis Mukonori, Zimbabwe Defence Minister Sydney Sekeramayi, State Security Minister Kembo Mohadi, Air Vice Marshal Elson Moyo, Permanent Secretary for Information, Media and Broadcasting Services George Charamba, among others. According to Zimbabwean officials, Mugabe is expected to quit and pave way for a transition government. The long-serving leader has also been seeking assurance of his family’s safety. Chipanga, who issued a statement on Tuesday attacking Zimbabwe Defense Force commander General Constantino Chiwega, has since tendered an unreserved apology to the army. “I can now confirm that Cabinet Ministers Jonathan Moyo and Saviour Kasukuwere have been picked up from President Mugabe’s “Blue Roof residence to KGV1 Military Barracks,” Zimbabwe media practitioner Zimbabwe Trevor Ncube tweeted. There are indication that Mnanagwa, sacked by Mugabe last week, is expected to take over the country in an interim capacity. Meamwhile the Herald Zimbabwe reports that Chipanga made a public apology after it was evidently clear Mugabe was gone Chipanga said he was a young man, still learning and had learnt a lot from the incident. “Public apology to Commander Zimbabwe Defence Forces General Constantino Guveya Chiwenga, Commander Zimbabwe National Army General Phillip Valerio Sibanda and the Air Force of Zimbabwe Commander Air Marshal Perrance Shiri and the generality of the Zimbabwe Defence Forces and the entire nation of Zimbabwe. I would like to apologise for the statement I made yesterday (Tuesday) together with my executive at the ZANU-PF Headquarters. I as leader of the revolutionary party’s Youth League, I have reflected and personally admitted that I erred. ‘‘I was ill-advised to read a statement which I and the Youth League had not originated neither authored. The document which I read I was handed it over by one Rodney Dangarembizi in the morning at around 8.30am which was denigrating your high office and your person,†he said. Chipanga implored Gen Chiwenga to accept his apology. “Therefore, I kindly request General Chiwenga to please Sir accept my apologies on behalf of the Youth League and myself. We are still young people. We are still growing up and learning from our mistakes. From this big mistake, we have learnt a lot,†he said. Chipanga said he was not forced or persuaded by anyone to apologise to the army hierarchy and had done so upon reflection. “I will also like to emphasise that this statement which I have given I have not been persuaded neither coerced or forced to do as such. I emphasise that I have reflected on my own as a young person, as the leader of the Youth League hence I have come to this juncture of offering myself to the State media to give this public apology. We shall also make frantic efforts to approach the commanders of our Defence Forces in person so that we convey this apology. I thank you.†On Tuesday Chipanga slammed Gen Chiwenga and the ZDF saying, “All those in security sector fatigues who wish to engage in politics are free to throw their hats in the ring and not hide behind the barrel of the gun’’ as he accused the ZDF of looting diamonds among other alleged infractions. Chipanga seems to have made the announcement under duress after he was reportedly arrested earlier the day. MISUSE OF PUBLIC FUNDS A SERIOUS THREAT TO NATION DEVELOPMENT The student’s leadership from the Copperbelt University COBUSU is deeply saddened with exacerbating misapplication of public funds which are solely meant to support poor Zambians wallowing in abject poverty. The recent published Auditor General’s report speaks volume to ordinary Zambians of what is taking place in these higher public offices. The Auditor Generals Report revealed more plunder of public resources. The report for the year 2016 indicates that misapplication of funds has increased from about K28 million in 2015 to over K162 million in 2016. We are very nonplussed with the report generally that came from the Ministry Of Higher Education which has revealed about K 8, 369 665 colossal monies were embezzled and misapplied. Our Public universities and colleges are in a dilapilated state where labs are no longer functional, no furniture in classes and teaching aids and poor sanitation. Furthermore, construction of student hostels has been slow due to lack of funding and yet individuals keep misusing funds meant for the development of this nation. In 2016, over 500 CBU students did not receive their project allowances and no reason was given as to why that happened. In addition, up to this time we still have over 550 unregistered first year CBU students who have not been given bursary hoping a listening government will positively respond to them. Over months now, the ministry which is fully aware of this has been silent after asking students to appeal for consideration. It is inhuman to keep students in uncertainty as they do not know their fate. This kind of recklessness must be condemned by all well-meaning Zambians and it should be credited with maximum denigration it deserves from the general public. Such levels of rapacity and venality should not be left unchecked. Zambian people should rise to the occasion and hold selfish leaders who are up to plunder and are deeply inclined in dubious and corrupt acts of obtaining public funds accountable and answerable for their sins. We demand that the law visits them. It is high time we spoke against such financial irregularities taking place in these offices; more especially in times where these same public office barriers come out in public to make false claims that government do not have sufficient resources to run the affairs of the nation whilst they are handsomely funded. This has been the case with the Ministry of Higher Education were monies have never been enough to sponsor vulnerable students and crediting their meal and book allowances when it’s due, fund the universities and colleges for normal operations but conspicuous misappropriations of funds are taking center of its operations. We urge Anti-Corruption Commission to with immediate effect institute investigations and thoroughly probe the ministry of Higher Education for misapplication of public funds and the possible embezzlements of public resources. We would also want to lodge in our humble appeal as students that His Excellency President Edgar Changwa Lungu should not let all those individuals with issues to sort and cleanse themselves with investigative agencies as they continue holding on to their respective ministerial positions as this will enhance transparency and equal application of law without interference. In conclusion, we want to caution individuals behind this evil act to stop before time catches up with them. Public funds should be used for their intended purpose, especially the Education sector. If the people been trained do not get quality services, we do not expect the nation to develop. We further ask the ministry to attend to the first year students in due time. As COBUSU, we will always be at the core-center of facilitating dialogue with government as this is the only possible mean of settling issues affecting our fellow students in various institutions of higher learning. MILITARY ‘TAKE OVER’ ZIMBABWE; DENY IT’S A COUP BUT PROCESS TO PACIFY INSTABILITY … Army Mouthpiece Says State Capture By Criminal Elements Will Not Be Tolerated. Zimbabwe’s army has announced a military take over potentially bringing Robert Mugabe’s 37 year rule to an end. Army General, through a spokesperson, announced on national television and radio around 3:51 AM Wednesday that the military was only targeting criminals surrounding President Mugabe. The army representative said the military take over was not a coup, but a process to pacify a situation that was degenerating into chaos. The officer said the president and his family were safe. Earlier in the night, the AFP News agency twitted exchange of gunfire near President Mugabe’s private residence. The US Embassy issued a statement urging its citizens in Zimbabwe to shelter owing to a fluid situation obtaining in the southern African nation. Moments later, the UK took similar precaution advising citizens to take measures and not fall into harm’s way in view of increased military activity. The day was marred with uncertainty following Zimbabwe Army Commander General Constantine Chiwenga’s threat on Monday that the military would take over if the situation in the governing ZANU-PF spiraled out of control. President Mugabe fired his deputy Emerson Mnangagwa a few weeks ago paving way for his wife to succeed the 93-year-old leader. ZANU-PF members have objected to plans by First Lady Grace Mugabe to succeed the aging leader. Zimbabweans will wake up to a different reality this morning. Bailiffs have reportedly seized 12 vehicles from the financially troubled Times of Zambia. Sources have disclosed that the company is failing to operate and servicing its debt has stretched its meager resources. Some employees have not been paid for over 8 months. “The company is officially in ICU. People who have the chance are jumping out and finding other alternatives,” a source said. “Operations at the firm are officially paralyzed and it’s likely to close in 3 weeks time as bailiffs have seized 12 vehicles from Times of Zambia.” While other sources say it is unlikely the Times will close in three week, operations are said to be affected by the liquidity situation at the company. Sources say only a good bailout from central government will help revive the operations at the company. MMD die-hard youth national coordinator Gerald Chiluba has accused former party president Dr Nevers Mumba of misleading opposition UPND president Hakainde Hichilema into not conceding defeat. Chiluba says the stubbornness of his former leader has rubbed off the UPND president who continues to refuse to concede defeat in the 2016 election despite the move being detrimental to the re-organisation of the party for the 2021 elections. He said Hichilema had not refused to concede defeat in the previous elections and now that he has surrounded himself with Dr Mumba he is negatively influenced to try to hang on to a lost cause. “As MMD die-hard youth wing, we have noted with keen interest over the upcoming behaviour of not conceding defeat syndrome by HH to have been influenced by Dr Nevers Mumba. “After analysing the behaviour and attitude of HH, of all the 5 times he has lost as president, it is evident that his unique character is as a result of his close interaction with Nevers Mumba. “Just like they say “bad association spoils good habits” HH is a victim of bad association and the earlier he thought twice about his associates the better for him and his party. “We say so because Dr Nevers has a destructive mind which if not curtailed can lead to the total destruction of the UPND. He has been misadvising the UPND to continue singing songs of the petition just like he has continued to claim the presidency of MMD when infact it is a public secret that Zambians cannot dance to such songs as they are not danceble,” he said. PF Kamwala Vice Youth Chairman Richard Soko is allegedly terrorizing residents of Kamwala in Lusaka using the ruling party banner. Soko has for months been accused of allegedly harassing residents of Kamwala in the name of the party. The latest incident happened when the official who is a mortuary attendant attacked a widow, her daughter and a son in law. Soko allegedly hurled insults at the couple last Friday. “Coming from his usually drinking sprees, Richard approached the car parked at the widow’s house in Kamwala and threatened to stub all three to death. “He said he was untouchable because he is a PF party cadre. The man was calling these people prostitutes,” the source said. According to the information obtained, Soko has since been reported to Kamwala Police but snubbed a call out for Monday. “He is also threatening people at Kamwala clinic where works as a mortuary attendant. He is openly boasting that no one can touch him because he is a PF official,” the source added. Soko is said to be unsettling many of his colleagues in the party although there seems to be no one to put the situation under control.
