National Guidance Minister Godfridah Sumaili has been acquitted on the contempt charges against UPND president Hakainde Hichilema and five others. The case has been added to the list of cases around Hichilema that have been peeling away. Resident Magistrate Ireen Wishimanga acquitted Sumaili on grounds that the prosecution team did not tender in any evidence against Sumaili. When the matter came up Magistrate Wishimanga set Sumaili free since the office of the Director of Public Prosecution that took over the case last week did not offer any evidence. Sumaili was cited for contempt after Hichilema complained of comments attributed to the minister that Hichilema had pushed President Edgar Lungu to send him to prison which the UPND leader construed to be contemptuous. Civil servants across the board have been awarded a salary increment of between 7.4 and 9.6 percent. According to a collective bargaining agreement signed between government and unions on Sunday evening workers represented by 11 unions will receive their rise with effect from January 2018. Negotiations were held over 10 days with consensus finally reached with Zambia Congress of Trade Unions (ZCTU) secretary general Cosmas Mukuka signing on behalf of the unions while Public Service Management Division permanent secretary Boniface Chimbwali signed on behalf of government. Radical revolutionary Party (RRP) president Vincent Chaile says the $42 Million fire contract given to Grandview might be a good case politically, but a very weak case in court and risks to be thrown out with costs. As a Party we were among the first ones to raise the eyebrow over this deal two years ago in 2015 before this issue was taken to International Court of Arbitration, Our legal team both local and those based in UK and Ukraine advised us to be reluctant on this issue as all procedure was followed consistent with the requirement of an the ZPPA act 2008, no 11. In this respect, it is clear that Grandview complied and competed well in an Open Competitive bidding (ICB). In open competitive bidding, the following procedure is key to the success of the bidding process. 1. Preliminary,(Legality of the Business) 2. Technique, (compliance and Specification) 3. Commercial (terms of Business) 4. Post Qualification (Financial Capability of the company) It Clear that Grandview international complied with the procedure and scored better than its competitors. As observed in the above procedure, Pricing is not the only factor considered in the bidding process, its actually a secondary factor. In fact The ZPPA or the procurement Act 2008, 11, does not provide negotiation of the price after the contract has been awarded. The issue of awarding the contract to Grandview is not the real problem, there is need to revise and repeal the act, to include provisions for price adjustments after awarding of the contract. In other words there is need to allow procurement committees to do market intelligence on price before a contract is signed… this will give authorities to re-negotiate the price in a situation realized that the successful bidder had overpriced the products, which is not a case in a current procurement act……. Therefore as a party we challenge Chishimba Kambwili who is in a self-destruction mode to provide us with tangible evidence on this issue than just been a Facebook pundit misleading oneself , so that maybe we can also be part of the people who are trying to protest over the issue. If people are going to use emotions over this issue, we see a situation where Grandview might walk away with another $42 million in compensation or damages if this issue is mishandled. For example the Zamtel Lap green case where government has lost more than $350 million in compensation due to illegal cancellation of a contract Am advising my fellow politicians to push for a review of the ZPPA or procurement act which is the culprit in this matter. Economic and Equity Party (EEP) President Chilufya Tayali has called on President Edgar Lungu to consider firing Labour Minister Joyce Nonde accusing her of being a letdown. Tayali claims that the Labour Minister has lamentably failed to execute her duties for the last one year. Tayali says Simukoko is lukewarm and does not deserve to handle labour matters. He says since government has been claiming of banning casualization in Zambia, the Labour Minister has failed to protect all the workers on casual basis including at Zesco, University Teaching Hospital and Dangote. He furthermore claims that the government including President Edgar Lungu is scared of the famous Dangote as most of his workers are on casual basis, work in poor conditions and get low wages. Tayali says it is for this reason that he has set February 5th, 2018 a day of national demonstration against casualization in Zambia saying all the workers who will be on casual should join in demonstrating. Meanwhile, the EPP Leader maintains that Roan Member of Parliament Chishimba Kambwili should not be treated as a Hero or as a whistle blower in terms of exposing corruption in government. Expelled Roan Member of Parliament Chishimba Kambwili says he is not talking about corruption in government because he has been removed. Kambwili who has become a crusader against government corruption says that even in his time in cabinet he was always vocal against graft. The Roan lawmaker said that whilst in government he was always raising queries using established channels. Kambwili said that his becoming loud on anti-government sentiments was not a question of sour grapes but that he was merely highlighting wrongs for the betterment of society. “It is not correct to say I am now talking about corruption because I am now outside government. Even when I was in cabinet you can ask I was always making noise on corruption it is just that there are channels that these matters are raised,†he said. Finance Minister Felix Mutati says that calls for his expulsion are meant to distract him from delivering in his job. Mutati has become a target of dissent among some Patriotic Front forces that have accused him of consolidating his position as a possible successor for President Edgar Lungu. Among other forces against Mutati are members accusing him of using government resources to support the MMD. His detractors allege that Mutati has been using government money to fund MMD projects like refurbishment of offices whilst PF offices are a sorry site. However, observers note that Mutati has been targeted for his strong stance against the release of funds. Mutati leads one of the MMD factions but is serving in the PF government. Chipimo said that Kambwili should be encouraged to ‘spill the beans’ as he was in government for a long time and would be trusted to give out accurate information about government. Kambwili has become the chief trumpeter against alleged government corruption after he was fired from government by President Edgar Lungu. Chipimo said that he could not dismiss Kambwili as just being bitter but one who could be used to highlight alleged government corruption. He said that Kambwili needed to be supported with the allegations he raised investigated by the law enforcement agencies. A Zambian Professor in the United States of America has been applauded for babysitting his student’s 10 month baby while during a lecture. Prof. Henry Musoma is a lecturer at one of the top US universities in Texas. When one of his students Ashton Robinson emailed giving notice of a situation with her childcare, Prof. Musoma had the most amazing feedback. The Zambian native called the student not to miss class but bring his 10-month-old baby named Emmett along. Ashton, a single mom, was astound. Not only did Prof. Musoma allow the single mom and baby to be in class, he also cared for the baby through the lecture as he doubled the babycare role with his teaching duties. Ashton said, “Definitely something I’ll never forget and can’t wait to someday tell Emmett that it’s because of people like this that mommy was able to graduate from the best university in the world.” Both Ashton and Prof. Musoma featured on a popular television show Ellen with viewers and followers of the programme praising the act as one of the most kind gesture a lecturer would offer to his student. The stanchions and column of public procurement includes openness to all eligible bidders, transparency, reliable source, time, quality and specifications. If the bidders meet the foregoing after satisfying the preliminary requirements(including statutory documentation), then commercial aspects come in including Price and delivery issues. Therefore, let the public fault the Act , not the procuring agency or indeed, the participating bidders who marely responded to an invitation to bid. If the Act had a provision for Price Range or scale consideration, then the public arguments would hold. Technical Newel is primary and the price is secondary consideration as far as public procurement is concerned in Zambia. The Zambia Public Procurement Agency has for a long time been talking about firmulating a standard price index to guide suppliers of the public sector. The process is still going on. So the buck stops at them. So any complaints and condemnation should be aimed at ZPPA. As a matter of fact, after the awarding of the Contract, Some bidders felt aggrieved and took this matter to court into it reached Arbitration. The International Court of Arbitration selected a very reserved Arbitrator who sat with all the parties in Capetown and a judgement was passed. Please read the Judgment. This Matter was even presented to Parliament and the parliamentary PAC cleared it . It was during this period that Zambians and any concerned people should have stood up to scrutinize and question all relevant authorities for the much needed information and any other concerns. But the matter was later on taken to the Anti Corruption Commission and they equally cleared it. As at now,the position we can take is to discuss how well such tenders should be conducted with regard to the interest of the public while considering other important priorities.
