Former UPND Vice President Dr Canisius Banda says his former party had become a perpetual cry baby over rigging allegations. Speaking when he featured on Breeze FM’s Political Hour programme on Thursday night, Dr Banda rubbished the incessant rigging allegations by the UPND. “I have not yet joined PF but I am supporting the President and the PF party because they are governing the country today. The UPND should respect President Lungu, he is the head of state he is Republican President, and they must go to the people to convince the people to vote for them. They mustn’t be cry-babies all the time. If there is rigging why is it that the people who rig don’t for them because if rigging is done they can rig for them, why do people rig against them all the time?†he asked. Dr Banda said the future for UPND is bleak and that they cannot even win in 2021. He also apologized to the people of Eastern Province for misleading them during his time in UPND. Minister of Justice, Given Lubinda is disappointed with The Zambia Institute of Advanced Legal Education for sidelining Private Higher Learning Institutions from consultations to review the second draft of the students rules contained in the legal practitioners act.   Lubinda said this when he officiated at the second stakeholders consultative meeting to review the second draft of the students rules contained in the legal practitioners act.   “I have received numerous complaints with regard to the implementation of the Legal Practitioners Act hence it was important that private universities should have been invited to this meeting to get their side of the story,†said Lubinda.   And Lubinda said there is no need to bend existing standards at ZIALE just to accommodate people wishing to become lawyers in the country because there is danger to graduate students who do not understand what it takes to be a legal practitioner.   “Maintaining high standards in the training of lawyers in Zambia will safeguard the legal profession from having what he termed as quack lawyers in the Legal system,†he said.   He said that the meeting will give recommendations a second glance with the view to conclude on the deliberations and finalize the draft student’s rules through the legislative drafting department of the ministry of Justice.   “The review of the student’s rules is long overdue as recommendations for the amendment of the students rules come as far back as 2011,†said Lubinda.   Lubinda reiterated that it will not add value to the legal fraternity by relaxing the current academic requirements being enforced by the Zambia institute advanced Legal Education.   “There is a proposal to that the rules be thoroughly reviewed in content, terminologies and definitions because it is felt that the rules are oppressive and punitive in their nature†said the Justice Minister.   Present at the meeting was the Law association of Zambia, the Zambia Qualifications Authority, some Public Universities and officers from the Zambia Law Development Commission among other Institutions.   The post Lubinda Trashes Lowering ZIALE Standards to Accommodate Low Scoring Students appeared first on Zambia Reports.

The Mpika Subordinate Court convicted and sentenced a notorious poacher, along with three others, to five years imprisonment with hard labour each on for poaching in the South Luangwa National Park. Joseph Chanda, 45, aka Kapolyo, who was on a wanted list for the past five years was arrested together with Dominic Mulenga, 61, Pephious Mukuka, 34, and Tiyeseko Sikalumbi, 35 by Department of National Parks and Wildlife (DNPW) on 20 June 2018 for poaching a buffalo in the park. They were also charged with unlawful possession of a shot gun topper; unlawful hunting in a national park contrary to section 128, Zambia Wildlife Act No. 14 of 2015 in the second count; and possession of government trophy (buffalo meat) contrary to section 97, Zambia Wildlife Act No. 14 of 2015 in the third count. After pleading guilty to all charges, the court fined the four men K2,000 each suspended in the first count. In the second count, the court imposed a 48 months custodial sentence for unlawful hunting. In the third count the Court sentenced the accused persons to 12 months in prison without the option of a fine. The sentences will run consecutively. The South Luangwa National Park is one of Zambia’s most popular and profitable national parks. In 2017, former United Nations World Tourism Organisation (UNWTO) Secretary General Dr. Taleb Rifaithe declared it as a park committed to sustainable tourism. This means local communities must ensure that they do not harm the natural habitat and wildlife in South Luangwa National Park. The Chinese National who allegedly shot a 16 year old boy and wounded him at Bolo Mine in Chambishi Township yesterday refused to take plea in the absence of his lawyer. This is in a matter Cheng Yuan Son is charged with one count of grievous harm contrary to the laws of Zambia. When the matter came up for plea before the Chambishi Magistrate Court, the accused refused to take plea in the absence of his lawyer claiming that he was only informed of the court appearance a day before. Particulars of the offense are that on June, 28th 2018 in Chambishi Township, Cheng Yuan Son allegedly caused grievous harm on a 16 year old boy contrary to section 229 of the penal code in the laws of Zambia. Magistrate Steven Mabona read out the charge to the suspect who remained silent. Magistrate Mabona said a plea of not guilty was recorded after the refused to speak in the absence of his Lawyer. The matter has since been adjourned to 11th July, 2018 for possible trial. Meanwhile, the Chinese Community on the Copperbelt have given a K 5, 000 cash to family of the boy who is still nursing injuries at Sinozam Hospital to help out with expenses.   Copperbelt Vice Chairman Cong Pei Qiang said the donation is meant to reduce burden on the family and should not be perceived as corruption. The Chingola Magistrate Court has amended to defilement from rape, the charge slapped on notorious Jerabo Victor Phiri popularly known as C4. Phiri has been slapped with the two amended charges which he has denied before Court. When the matter cams up before Magistrate Pestone Chiluba for continued trial, the state applied that the charge be amended arguing that the accused has not taken defence. However, the defence was quick to object the application from the state. Magistrate Chiluba said he had taken both the state and the defense statement and that the state had backed their application with an amended law. He said such amendments are allowed at any stage of trial provided the accused has not taken his defense and later granted the application to the state. Particulars in the case are that on 9th and 10th August, 2017, the accused did have carnal knowledge of the juvenile without her consent contrary to the Laws of Zambia.
