Canada-based lawyer Elias Munshya Wa Munshya has is sticking his neck out telling President Edgar Lungu he was not eligible to contest the 2021 presidential election because he would have served out his two terms and is constitutionally barred from seeking a third term mandate. Munshya says the fact that the constitution has been amended is not sufficient ground to qualify the growing argument President Lungu is eligible for 2021. President Lungu has since challenged those disputing he is eligible for 2021 to take the matter to court. The Head of State declared on his visit to Ndola yesterday he was eying re-election when elections are called in August 2021. But Munshya has categorically stated that the Head of State is not eligible. “President Lungu first ran for the presidency under Constitution 1996 in 2015 and that was a full term which terminated in 2016. That which was a presidential term under Constitution 1996 is still a term under Constitution 2016. “Constitution 2016 cannot retroactively cancel that which was regarded as a presidential term under Constitution 1996. Constitution 2016 does not automatically make Mr. Rupiah Banda eligible to two more presidential terms, just as it does not make Mr. Edgar Lungu eligible to run again in 2021. “If we followed the logic that Constitution 2016 retroactively makes Mr. Lungu eligible, we would have no law and certainly no constitution. It would mean that any president can then each year push through constitutional amendments that make them start afresh and remain in power indefinitely. “President Lungu assumed his first presidential term under a constitution that stated clearly that he could only run one more time and not two more times. He knew what he was getting himself into. He should not be misled by amanone of the presidential Benz. “In 2021, His Excellency must vacate the office and respect the Constitution 1996 under whose wings he first flew to Nkwazi House,” Munshya states. Governance activist Isaac Mwanza has also added his voice to the debate saying President Lungu is constitutionally barred from contesting the 2021 election because it will translate into a third term. Munshya supported President Lungu’s election in 2015 and 2016 while Isaac Mwanza has occasionally been viewed to align with the ruling party although most of his arguments are generally objective and backed by sound legal authority. Zambia’s captain Rainford Kalaba was voted third best player on the continent losing out the CAF Player of the Year Award – Based in Africa to goalkeeper Dennis Onyango of Uganda. Kalaba, who stars for DR Congo side TP Mazembe, was third after Khama Billiat was voted runner up in the race. According to the CAF website, history was made at the International Conference Centre in Abuja with the coronation of Algerian winger Riyad Mahrez as African Player of the Year 2016 and Ugandan goalie, Denis Onyango as African Player of the Year – Based in Africa 2016. Mahrez, 25, becomes the first Algerian and the maiden North African to win the prestigious individual honour in African football since its inception by the Confederation Africaine de Football (CAF) in 1992. The playmaker, who played an influential role in the historic Premier League title triumph by English club, Leicester City, last season and Algeria’s qualification to the Total Africa Cup of Nations Gabon 2017, polled 361 votes to emerge winner in the polls. He thus dethroned last year’s winner, Pierre-Emerick Aubameyang of Gabon who garnered 313 votes, whilst Senegalese forward, Sadio Mane placed a distant third with 186 votes. The winner was decided by votes from the Head Coaches or Technical Directors of the National Associations affiliated to CAF, members of the CAF Media Committee, members of the CAF Technical and Development Committee and a 20-member panel of experts. For the African Player of the Year – Based in Africa, Onyango also wrote his name in African football folklore, by becoming the first goalkeeper to scoop the award designed to reward players who ply their trade on the continent. The 31-year old, whose exploits in the posts was critical to Uganda’s qualification to the Africa Cup of Nations for the first time after a 39-year hiatus, and also starred in Mamelodi Sundowns’ conquest of Africa last year tallied 252 votes, 24 more than his club-mate, Khama Billiat of Zimbabwe. The Zambia Under-20 national team began their preparations for the 2017 Total Africa Cup with Coach Beston Chambeshi warning some of the players still having a hangover from the Cosafa victory that they may be dropped. During the opening session at Sunset Stadium, Chambeshi expressed disappointment that some of the players summoned to camp had not yet reported despite the weight of responsibility the country was attaching to the Under-20 tournament. Only 12 of the summoned 24 players reported for camp on the opening day of the camp that will go until the tournament that kicks off next month. “The door is open. You know the way some of the boys behave, they may think that winning the Cosafa was the end of the world but we are looking at them to see how they behave,†he said. Chambeshi said his team will have some few foreign based players to beef up the team that will carry the Zambian flag. “We have players coming from outside the country and we are still working on that. By next week you may hear two or three players coming from Europe,†he said. Chambeshi said some Under-17 lads that minted bronze at the African Union Games may get a look in on the recommendation of Coach Numba Mumamba. The technical bench has also roped in Cell City Football Club goalie James Phiri junior, son of1994 Africa Cup silver medallist gloves man. Chambeshi said that the team was hoping the planned European camp materialises to give the lads top grade preparations. Zambia is in Group A alongside Egypt, Mali and Guinea. Top four teams at the tournament will get automatic qualification to the FIFA Under-20 World Cup in South Korea.
