LUSAKA lawyer Martha Mushipe has dragged her client United Party for National Development (UPND) Kaoma Central Member of Parliament Sitwala Sitwala to court for non-payment of legal fees. Mushipe has accused the MP of refusing to settle the sum of K45, 000 for professional services rendered to him. The UPND lawyer claims that on instructions from her client, she represented him in an election petition matter where Austin Liato sued him for the nullification of his seat in Parliament. “On the 9th September, 2016 the plaintiff received instructions from the defendant to represent him. The plaintiff and the defendant entered into an agreement and signed an engagement letter accepting the conditions,†she said. “Despite repeated reminders, the defendant has refused, neglected and ignored to settle the outstanding legal fees which are rightfully due to the plaintiff for legal and professional services rendered to them.†Mushipe submitted to court that Sitwala had issued instructions of termination of contract to her firm on September 30, 2016 without payment of the legal fees when the lawyer already concluded his case before court. She has since requested the courts to compel the parliamentarian to immediately pay the legal fees owing as per agreement, including interest at current commercial bank rate to the date of settlement. The High Court previously dismissed Liato’s petition and upheld that Sitwala as the duly elected Member of Parliament. PF lawyer and Kabwe parliamentarian Tutwa Ngulube says the ruling party will respect the three arms of government and allow institutions such as the judiciary to operate independently. Ngulube’s comment comes in the wake of a tiff between President Edgar Lungu’s spokesperson Amos Chanda and Law Association of Zambia president Linda Kasonde, Chanda had made comments on the judiciary that LAZ viewed as incriminatory and an affront to judicial independence. BELOW IS NGULUBE’S CONTRIBUTION Featuring on the PF Interactive Forum today Honorable Tutwa Ngulube said that Patriotic Front (PF) will allow all the three organs of the government operate independently and that PF won’t subdue the courts. “PF respects the rule of law” he said. Mr Ngulube has expressed disappointment the manner in which the Law association of Zambia (LAZ) has been labled as a political institution by the public. He said that LAZ was not created to fight the government or only seen to be working when the president speaks. ” We wish LAZ can be independent and avoid partisan politics” he said. He said that its unfortunate that the law institution is perpetually commenting on political matters when there many other issues that need their attention. He as well feared that in future LAZ would wish to slot in their people to stand as independent candidates in politics. “The role of LAZ is to give legal guidance to the lawyers and the government” Moreover,Mr Ngulube observed that LAZ is putting the Attorney general in what he described as an ’embarrassing situation’ because the attorney wouldn’t know whether to side the government or to side the Law association. He added that this acrimony must not continue but brought to an end. Regarding the judiciary, Kabwe Central law maker said PF want a Judiciary that will stick to what the constitution says. He cited an example of the last Presidential petition in which the Constitutional court kept changing judgments. “The presidential petition was embarrassing” he said. He said that the Judiciary must be independent and impartial. “Even in the on going petitions PF won’t engage itself in name calling on judiciary and we will respect the outcome from the judiciary.” Said Mr Ngulube. While answering a question from one journalist Mr Ngulube only wished that the Judicial Complaint Authority had teeth to discipline the behavior of lawyers who have now turned political and operate on friendship and nepotism. The law maker observed that People have now lost confidence in the judiciary as they think its impossible to win a case in court if you are suing a richer man than you. He said this is not good and must come to an end. Tutwa further said it is not illegal if people are calling for the formation of another body of Law association for the attainment of checks and balances.
